Terms of Service

These Terms of Service govern your use of Argus The Watcher ("Argus"), operated by 17035322 Canada Inc.. By creating an Argus account or using the service, you agree to these Terms.

1. What Argus Does

Argus monitors email accounts that you choose to connect and looks for messages matching rules or contacts that you have configured as important.

When Argus detects a matching message, it may send an alert using SMS text messaging or other notification methods supported by the service.

Argus is designed to help you notice important messages. It does not replace your email provider, email application, or normal responsibility for reviewing your communications.

2. Your Account

You are responsible for providing accurate account information and maintaining control of the email addresses, telephone numbers, and third-party accounts connected to Argus.

You may not connect an email account, telephone number, or other service that you do not own or have authorization to use.

You are responsible for activity performed through your Argus account.

3. Connected Email Accounts

Argus may connect to supported email providers using methods such as Google OAuth, Microsoft OAuth, IMAP, or other supported technologies.

When you authorize a third-party service such as Google, Argus receives only the permissions you approve during the authorization process. For Gmail, Argus requests read-only access and does not use that authorization to send, modify, delete, or archive messages in your Gmail account.

You may revoke access to a connected account through the applicable email provider. You may also contact Argus support to request removal of a connected account.

4. AI Summary

Argus may offer an optional AI Summary feature that analyzes relevant email content to create a concise summary, identify whether a message appears to require action, and indicate its apparent urgency.

When AI Summary is enabled, relevant email content may be sent to OpenAI for processing. You can disable AI Summary in your Argus account settings.

AI-generated summaries and suggested actions may contain errors, omissions, or incorrect interpretations. They are provided for convenience only and should not be relied upon as a substitute for reviewing the original email when making important decisions.

5. SMS Text Alerts

By providing a mobile telephone number and enabling SMS notifications, you authorize Argus to send service-related text messages to that number.

Message and data rates charged by your mobile carrier may apply. The number and frequency of messages will depend on your Argus configuration and the email activity matching your rules.

Delivery of SMS messages depends on third-party telecommunications providers and cannot be guaranteed.

6. Alerts Are Not Guaranteed

Argus is designed to improve awareness of important email, but no monitoring or notification system can guarantee delivery of every alert.

Email providers, Internet connectivity, telecommunications networks, third-party APIs, server outages, configuration errors, maintenance, and other circumstances may delay or prevent an alert.

You should not use Argus as the sole notification method for emergencies, medical situations, public safety, life-safety systems, or other circumstances where failure or delay could result in serious harm.

7. Driving and Vehicle Use

Argus may provide notifications that can be displayed or read aloud by compatible phones, vehicles, or hands-free systems.

Argus does not make distracted driving safe. You are responsible for complying with applicable driving laws and for operating your vehicle safely.

Do not interact with your phone, Argus, email, or any other application while driving when doing so would be unsafe or unlawful.

8. Acceptable Use

You may not use Argus to violate any law, gain unauthorized access to another person's communications, interfere with the service, abuse telecommunications systems, distribute malicious content, or engage in fraudulent activity.

We may suspend or terminate accounts that abuse the service, create unreasonable system load, threaten the security of the service, or violate these Terms.

9. Subscriptions, Trials and Payment

Some Argus features may be offered through free trials, paid subscriptions, usage-based charges, or other pricing arrangements described on the Argus website.

Applicable prices and included usage will be presented before you purchase a paid service.

Unless otherwise stated, paid services may be cancelled at any time. Cancellation stops future service or renewal as applicable, but does not necessarily provide a refund for service already purchased, delivered, or used.

10. Third-Party Services

Argus depends on third-party services that may include Google and other email providers, Twilio or other telecommunications providers, OpenAI when AI Summary is enabled, payment processors, hosting providers, and other technology services.

We are not responsible for outages, service changes, restrictions, or failures caused by third-party providers that are outside our reasonable control.

11. Privacy

Your use of Argus is also governed by our Privacy Policy, which explains how information is accessed, used, stored, shared, and protected.

12. Intellectual Property

Argus, its software, website, branding, designs, and related materials are owned by 17035322 Canada Inc.. or its licensors and are protected by applicable intellectual property laws.

These Terms do not transfer ownership of Argus or its software to you.

13. Service Availability and Changes

We may update, modify, add, or remove features as Argus evolves. We may also perform maintenance or temporarily suspend portions of the service when reasonably necessary.

We do not guarantee that Argus will always be available, uninterrupted, or error-free.

14. Disclaimer of Warranties

To the extent permitted by applicable law, Argus is provided "as is" and "as available" without warranties or conditions of any kind, whether express or implied.

15. Limitation of Liability

To the extent permitted by applicable law, 17035322 Canada Inc.. will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of, inability to use, or reliance upon Argus.

This includes losses resulting from delayed, missing, incorrectly classified, summarized, or undelivered email notifications, AI-generated information, or SMS messages.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

16. Termination

You may stop using Argus at any time.

We may suspend or terminate access when reasonably necessary to protect the service, comply with law, prevent abuse, or enforce these Terms.

17. Changes to These Terms

These Terms may be updated as Argus evolves. When material changes are made, the updated Terms and revision date will be published on this page.

Continued use of Argus after updated Terms become effective constitutes acceptance of the revised Terms where permitted by applicable law.

18. Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
